The Continuing Legal Education Course will be substantive in nature and focus on providing practical tips for those engaging in Settlement Conferences in the Eastern District of Pennsylvania (EDPA).
The class will discuss alternative dispute resolutions (ADR) under EDPA Local Rule 53.3, when litigants should consider ADR, when cases are referred to magistrate judges for settlement conferences at a Rule 16 Conference, how to request settlement conferences before a magistrate judge, how magistrate judges are selected, preparation for settlement conferences or mediation, the mechanics of mediation and settlement conferences, other considerations such as opening statements or private conferences with parties, caucuses, ethical considerations, and post conference issues. Completion of this course fulfills a substantive credit towards the annual CLE requirements.
